Virginia Democrats Press Major New Gun Control Measures Despite GOP Opposition

Virginia Gov. Glenn Yankin's announcement this month that he believes the state's gun laws are already strict enough hasn't stopped Democrats from pushing key proposals that would limit access to guns.
Policy committees in both houses of the General Assembly have begun pushing major gun control bills while resisting Republican efforts to repeal existing gun restrictions and legalize guns in more places.
On both sides of the Legislature, bills banning the future sale of assault weapons and large magazines passed by bipartisan committee votes. Bills have also been proposed to ban so-called "guns," untraceable firearms assembled at home, often from DIY kits that can be purchased online.
Other bills have been introduced that would require a five-day waiting period for all gun purchases, require buyers to demonstrate knowledge through a gun safety course, impose a $500 civil penalty for leaving a handgun open in a vehicle unattended, and repeal the ban on gun safety. a weapon for everyone. with two DUI convictions within five years of carrying an existing firearm in public and the requirement to obtain a government permit before purchasing a weapon.

But advocates for stricter gun laws appear steadfast, portraying the new bills as a clever attempt to stop gun violence before it happens rather than redoubling their efforts to prosecute offenders.
“We hope the governor will support these actions and save lives across the commonwealth,” said Laurie Haas, a longtime gun violence prevention activist whose daughter was wounded in the 2007 mass shooting at Virginia Tech.
Most votes on gun laws this session predictably split along party lines, with debate at times contentious.
At a House subcommittee hearing on assault weapons legislation last week, Rep. A.C. Cardoso, R-Hampton, one of the few black Republicans in state politics, noted that weapons of any kind are rarely used in gun homicides. He said most gun homicides involve guns being used against black men.
"Why don't you have a bill that would end violence against African Americans?" Cardoso said.
Rep. Dan Helmer, a Fairfax Democrat and supporter of assault weapons legislation, said Democrats have introduced numerous bills aimed at stopping more common forms of gun violence.
“I am deeply concerned that the delegate does not want the 5 percent murder rate in the Commonwealth to stop,” Helmer said. “Because I think 5% is too much.”
Rep. Marcus Simon, a Fairfax Democrat, also weighed in and said he would be happy to talk to Cardoso about which party has the best track record of preventing gun violence in communities of color.
“This is not a baseline situation,” said Simon, chairman of the House Public Safety Committee. “I cannot ignore this proposal. I can't leave him."
The assault weapons bill passed the House Public Safety Committee last week by a vote of 11 to 9. Its counterpart in the other chamber received the green light from the Senate Judiciary Committee on Monday by a vote of 9 to 6.
Defining an assault weapon has been a challenge for lawmakers in the past. A bill being debated this year defines them as weapons that can be used with high-capacity magazines and other modifications such as stocks, grips and suppressors. Democrats on the panel disputed that claim, saying the law has been used more than 1,000 times without major legal challenges, citing loopholes in its due process provisions.
While Youngkin is widely expected to veto more sweeping gun legislation brought to him by Democrats, it will be harder for the governor to reject more modest proposals outright.
Democrats are pushing to strengthen the state's gun safety laws with bills that would hold gun owners accountable if a minor obtains a gun and uses it to commit a crime.
Sen. Dave Marsden, D-Fairfax, introduced a bill that would fine gun owners who leave their guns in unattended vehicles in full view of passersby and said he hopes the governor will use his proposal to curb what he called widespread gun theft. . from cars. . Vet Techs Dog Donates Blood To Save K9s Life After Shooting
FONDS DU LAC, Wisconsin. (Gray News) - A Wisconsin K-9 was seriously injured Saturday morning, but he has a chance of survival thanks to another dog.
According to the Fond du Lac County Sheriff's Office, K-9 Iro was shot when officers responded to a gun alarm.
When officers arrived, they found a man in the vehicle and an exchange of gunfire ensued, officials said. The suspect died at the scene and K-9 Iro suffered a serious gunshot wound.
No other officers were injured, the sheriff's office said.
K-9 Iro was taken to an emergency animal hospital for medical treatment.
Before the lengthy surgery, K-9 Iro was stabilized thanks to a blood transfusion from another dog.
The sheriff's office said the yellow lab named Dwyer, who belongs to a veterinary technician, had a blood type that matched K-9 Iro.
“Dwyer’s blood type matched our K-9 and the veterinarian and Dwyer wanted to donate his blood to help our K-9,” the sheriff’s office said. “The transfusion worked and increased the amount of blood to perform this important operation.”
After undergoing extensive surgery, K-9 Iro remains in critical but stable condition.
"He's not out of the woods yet, but he is a young, healthy and strong dog, and his team of professionals are doing everything they can to help him," the sheriff's office said. "He was awake and alert enough to meet with his vice principal this morning and was able to spend some time growing his favorite toy (a tennis ball) before surgery."
On Monday, K-9 Iro was stable and without any major setbacks. He spent time with his owner and “went outside” to get some fresh air in his hospital bed.
“Tonight he looked up and saw his favorite toy, a tennis ball. All very positive signs," the officials said.
The goal on Tuesday was to board the K-9 Iro. He far exceeded that goal, standing up with the help of the vets and even taking a few slow steps.
The suspect's murder is being investigated by the Wisconsin Department of Justice Criminal Investigation Division.
The deputy involved was wearing a body camera during the shooting. The deputy has been placed on administrative leave per department policy.

Report On Virginia Mass Shooting Recommends More Police Training, Victim Funds
NORFOLK, Wash. (AP) - A state commission has called for several changes in how Virginia and its communities respond to mass shootings, from providing funding to victims to educating citizens about how to slow bleeding before paramedics arrive.
But the commission's final report on the 2019 mass shooting at a government building in Virginia Beach contained little new or overt criticism of how it handled the massacre.
A city engineer killed twelve people and wounded four before being killed by the police. The shooter, DeWayne Craddock, had legally purchased six guns in the three years before the attack, including the two .45-caliber handguns that were used, authorities said.
The FBI's Behavioral Analysis Unit determined in 2021 that the shooting was "motivated by workplace complaints." However, the agency has warned that it has not been able to "identify the combination of behaviors that may have preceded the attack" by any individual or group.
Ahead of its release this week, some of the victims' families saw the commission's latest report as their last chance to file a report. They argued that supervisors in Craddock's office failed to recognize the warning signs of a toxic workplace.
Instead, the document includes recommendations for state lawmakers to better prevent and respond to future violence, including in government workplaces.
For example, the commission said states should require local governments to develop emergency response plans, and first responders should have access to all parts of all government buildings. In 2019, Virginia Beach police were sometimes unable to deal with the shooting because they didn't have tickets to enter the second floor.
This report recognizes the limitations of the Commission as an investigative body. Obstacles include the lack of authority to call on city staff and the lack of adequate funding.
The report said the commission investigating the 2007 Virginia Tech massacre had a budget of $460,000 and eight volunteer attorneys. The Virginia Beach Commission has no volunteer attorneys and a budget of $38,500.
The panel "does not respond to psychological, security, human resources consultants or to bring in attorneys with expertise in mass shootings," the report said.
The committee initially had 21 members, and scheduling problems and meeting cancellations caused it. Virginia's attorney general criticized the board in December for its "severe dysfunction" and the resignation of nearly half of its members.
Commission Chairman Ryant Washington did not immediately respond to a LinkedIn message seeking comment.
Commission member David Kariens, who resigned before the final report was published, said the commission had failed.
"He said the Legislature should do an investigation," said Cariens, who resigned on the grounds, among other things, that the commission lacked investigative authority. "Production is not research. This is a college essay.
James Alan Fox, a professor of criminology, law and public policy at Northeastern University, said that contrary to reports after other mass shootings, the Virginia Beach document does not address gun restrictions.
"They don't look at whether Virginia's gun laws are appropriate," said Fox, who maintains a database of mass shootings by the Associated Press, USA Today and Northeastern University.
"States that ban high-capacity magazines have far fewer victims," Fox added, noting that Virginia has no such restrictions.
Much of the 16-page report focuses on the need for better training and planning for police, paramedics and city workers.
For example, it urged states to fund first responder training "on the emotional complexities of surviving mass shootings."
"Survivors and families of the Virginia Beach mass shooting reported that families and survivors were abused," the report said.
The commission said the country should also consider establishing a mass violence fund to provide medical aid to victims. Local governments also need to improve their knowledge of how to slow blood loss. The report refers to a federal training program, "Help You Until Help Comes."
Jason Nixon, whose wife Kate was killed in the shooting, hopes the commission will hold Virginia Beach city officials accountable for what he calls a toxic workplace.
"There's some good stuff in there that could help other families in the future," she said. "But the overall purpose of the investigation is to ensure accountability."
A spokeswoman for the City of Virginia Beach, Tiffany Russell, said her party was still reviewing the report. However, he said he would evaluate the recommendations and decide what action to take.
In January 2021, the city's human resources department implemented a centralized system "to track potential workplace violence incidents and investigate complaints," Russell said. No such system was in place when the shooting occurred on May 31, 2019.

Body Cam Footage Released In Fatal Police Shooting At Rochester Tech Park
The New York Attorney General's Office has released body camera footage of the August 6 shooting of police officer Daniel Legler.
Legler, 35, was shot and killed in a field near Rochester Technology Park after police said he shot and killed New York State Trooper Dominic Caito.
According to state police, the collision began on Interstate 490 near Innovation Field when Kaito attempted to stop Legler's car for an overdue state inspection. Legler did not comply and headed west on Highway 531 to Gates.
Police said shortly after the traffic stop, Legler exited the Rochester Technology Park Freeway onto Elmgrove Road, where he hit a guardrail, jumped a curb and fell into a field.
As Kaito attempted to arrest the driver, the two men argued before Legler fired "at close range from the officer," police said. Kaito shot Legler.

The New York Attorney General's Office is responsible for investigating all incidents in which a police officer may have caused the death of another person. Whenever possible, the office strives to release body camera footage to increase transparency about these incidents.
The investigation into Legler's death is ongoing, but the office said officers recovered a firearm at the scene. On average, it took the agency just over a year to present its findings.
The State Attorney's Office released 2 minutes, 37 seconds of Kaito's body camera footage of the incident as he followed Legler onto the highway with his lights and sirens activated.
The footage shows Kaito getting out of the car but keeping his distance from Legler, ordering the man to stay in the car six times over the next 30 seconds and warning Legler that a police dog was approaching and that he was being held at gunpoint. . .
Legler gets out of the car and starts to walk away, but trips and falls. Kaito then approaches the man, orders him to stay on the ground and shoots him in the stomach, telling Legler that he has a stun gun. “Don’t do that,” Legler countered.
Seconds later, the officer screamed and ran back to his police car, shooting Legler multiple times in the back as he stood. It is unclear what exactly the officer saw or heard that caused him to flee.
Kaito stops not far from him, shots are heard over the radio, and Legler continues to shout for him to get down on the ground. Legler stands still and does not move. Kaito throws another punch and Legler goes down. About 20 seconds passed between the first and last shot.
“They disappeared into the square,” Kaito told police radio. “The suspect is lying on the ground. He has a gun, but I don't know where it is. I’ll run back for cover.”

"So if you look at the footage from Parkland at Topps Market in Uvalde, you'll see that in all of these situations the shooter was clearly visible beforehand on the security cameras," Frazier said.
The key here, according to Frazier, is to spot the weapon before it reaches the school.
"Most incidents involving active shooting occur outside buildings — about 70 percent of them are in reality," Fraser explained.
AI now works full time in Charles County schools. Equipment is installed and ready for the start of the school year.
Because it complements existing safety regulations, Stoddard says it's the most effective way to improve student safety.
"It's a fairly easy-to-announce fruit. It's a win-win for everyone. There are no ethical issues with it, it's not a recording, it doesn't use facial recognition," Stoddard said.
Omnilert started implementing this technology about a year ago, and it is already in use in hundreds of schools. The CEO expects that number to grow into the thousands very quickly.
